    Notes:

DIVORCE ACTIONS. Undefended Action. Kathleen Jane Horstman, of Mt Morgan, petitioned for a dissolution of her marriage with William Henry Horstman on the grounds of desertion. Mr. E. R. Larcombe, instructed by Messrs. Hobler and Powell, appeared for the petitioner. There was no appearance of the defendant. Formal evidence of serving the writ on the defendant was given by Francis William Tooth, Supreme Court bailiff. The petitioner stated that she wa married to the defendant at Mt Morgan on March 11th, 1918, according to the rites of the Roman Catholic Church. After her marriage she lived and cohabited with her husband at Mt Morgan and Rockhampton. The issue of the marriage was one child, now eight years old. At this stage petitioner tendered the marriage certificate and His Honour remarked: "One of those youthful marriages. The husband was 20 and the girl was 17." Mr. Larcombe: The parents consent is endorsed on the back. His Honour: That's too young to marry. Continuing her evidence, the petitioner stated that her husband commenced to drink after their marriage, and he did not give her enough money on which to live. He left his employ ment in the mine at Mt. Morgan, came to Rockhampton, and secured a position in an orchestra. He was earning three pounds or three pounds 10 shillings, and he only gave her two pounds a week, sometimes less, to keep house, pay rent, and buy clothes for her husband. Towards the end of 1921 they had no clothes and she told her husband there was not sufficient money to clothe herself and the child. Her husband replied that if she wanted any more she could go out and work to get it, as he could not give her any more. Witness then secured a position as a cook and had supported her child and herself ever since. Her husband had not since contributed towards their support. In fact, when he she first started work he came to her for money. She told him that he should be supporing her, but gave him money. About three years ago be met witness in the street and asked her to make it up. She agreed to do so, provided he stopped drinking for a fortnight and straightened himself up. He said he would and asked witness to buy him a suit, as he had no clothes. She paid ?6 for a suit and gave him ?3 and promised to return at the end of a fortnight. When the time had expired she went to him, only to be abused by the defendant, who said all he wanted was the suit and that witness could get along the best way she could. As she was still maintaining the child, she requested His Honour to grant her the custody of it. His Honour granted an order nisi, returnable within three months, ordered the defendant to pay the costs of the action, and granted the petitioner custody of the child.
