    Notes:

    James was was a tenant farmer at Shanchenshaw, Fetteresso, from before 1840 to 1852, where he paid sums of ?68 (for land?) and ?1 (for house?) to his landlord and cousin George Silver. He then farmed at Kintoulin 1852-1865, where he had 106 acres and employed two labourers and one boy. He died aged 54* on 30 May 1865 at Kintoulin (Kintewline, Maryculter) (Banchory Devenick grave 93 p.20). He was the third child of Alexander Silver and Elizabeth Stirling who were married at Banchory Devenick on 28 August 1803 (contracted 6 August).
    *Note that he would have been 57 based on baptism record. Either the age is wrong or perhaps the James baptised 1808 (https://www.familysearch.org/ark:/61903/1:1:XBHQ-7DQ) died young and he is the "second" James born to Alex Silver and Elizabeth Stirling.

In presence of Alexander Burns Shand Esquire, Advocate Commissary of the Commissariat of Kincardineshire, compeared Charles Graham Morris, Writer in Stonehaven as Procurator and gave in the Inventory of the personal estate of the deceased James Silver and Oath thereon underwritten desiring that the same might be inserted and registered in the Commissary Court Books of said shire along with a Testamentary Writing executed by the said deceased, which desire the said Commissary found reasonable and ordained the same to be done accordingly and of which Inventory and Testamentary Writing the tenor follows visits Inventory of the Personal Estate wheresoever situated of James Silver - Farmer in Kintewlin in the Parish of Maryculter and County of Kincardine, who died at Kintewlin on the thirtieth day of May, One thousand eight hundred and sixty five :-

This is the Inventory of the Personal Estate of James Silver referred to in any Deposition of this date (signed : Agnes Silver / Alex Fraser JP at Aberdeen the fifteenth day of September One Thousand eight hundred and sixty five, in presence of Alexander Fraser Esquire, One of Her Majesty's Justices of the Peace for the County of Aberdeen. Appeared Mrs Agnes Thomson or Silver residing at Kintewlin in the Parish of Maryculter, Executrise of the deceased James Silver, farmer, there who having solemnly sworn and examined depones: That the said James Silver died at Kintewlin aforesaid upon the thirtieth day of May last and the deponent has entered upon the possession and management of his personal or moveable estate as Executrise Dative Qua Relict. That the Deponent does not know of any testamentary settlement or Writing relative to the disposal of the deceased's personal estate or effects or any part thereof other than a Holograph Testamentary Writing dated the eleventh day of May, One thousand eight hundred and sixty five which is now exhibited and signed by the Deponent and the said Justice of the Peace at this date as relative hereto. That the foregoing inventory signed by the Deponent and the said Justice of the Peace as relative hereto is a full and complete Inventory of the personal estate and effects of the said deceased James Silver wheresoever situated and belonging or due to him beneficially at the time of his death in so far as the same has come to the Deponents knowledge. That the Deponent does not know of any money or property belonging to the deceased liable to the duty imposed by the Acts 23 Vict @ 15 and 24 Vict C80. That the value at this date of the said personal estate and effects situated in the United Kingdom including the proceeds accrued thereon down to this date is three hundred pounds sterling and under Four hundred and fifty pounds Sterling. All which is truth as the deponent shall answer to God (signed) Agnes Silver and Alex Fraser JP.


    Following testamentary writing before meution Kintewlin May 11th 1865. Testament of James Silver to his wife and family supposed to be in a dying way being 7 years of the Lease to run to be governed by his wife Agnes Thomson and his son William and John Silver and at the end of the lease William Silver is to get 60 pounds more than any of the rest and John Silver to get 50 and James Silver 30 pounds and Alexander Silver 30 and the rest to be divided among the rest to of any family equal and 3 shares to his wife Agnes Thompson Kintewlin - James Silver


    No one of My family to have any claim upon my effects during the lease, But my wife Agnes Thompson and William Silver and John Silver.
    I have my whole effects with them during that time (signed) James Silver / Agnes Thomson / William Silver / John Silver - Aberdeen - 15th September 1865. This is the holograph Testamentary Writing referred to in any Deposition of this date (signed) Agnes Silver and Alex Fraser JP.

She was the second child of James Thomson, a miller, and Jean Smith. This couple were married at Fordoun 22 December 1810. In 1881 Agnes was living alone as an "annuitant" at Margaret Place, Old Machar, Aberdeen . She died 3 January 1905 at East Peterculter/Woodbank (her father-in-law Alexander's tombstone 6, grave 93 p.20, says "Woodend Cottage Cults).
